      <title>Building Equity</title>

      <description>&lt;div&gt;Last night I fucked up on a caricature job in Santa Cruz. I got the dates wrong for the gig and showed up a whole day late! Needless to say I screwed myself out of my fee, the half tank of gas it took to get there and back and had to send an apology to the person that contracted me for my mix-up. At this moment I feel pretty stupid.
&lt;br/&gt;
&lt;br/&gt;But it does bring home the major flaw with my caricature business as a business model. Though I make more money per hour doing caricature than I do in any other capacity, I have no real equity from it. The business only makes money when I go out and do these gigs. No different than if I was playing piano bars for a living. On the long drive back from Santa Cruz, I realized that I have no more equity now than when I did when I started 20 years ago. I don't so much have a business, as I really just own a job.
&lt;br/&gt;
&lt;br/&gt;Which brings me to thinking about the whole concept of Equity for artists. For my business to create equity it must build value from something other than my direct labor. I've been working on my illustrations and a plan to market them as greeting cards, t-shirts and flash art for tattoos. I've been feeling foolish about this idea because it takes much more money to do than caricatures and doesn't promise as big a cash flow. But it is a business model that would allow me to start building equity from my art. 
&lt;br/&gt;
&lt;br/&gt;It is like a musician moving from doing live shows to producing records. You can make a lot of money touring but if you don't tour you don't make money. But once you make a record and get it out there. You can make money for years (if it is popular) without stepping in the studio again. Of course this is a vast simplification of the music industry but it shows the difference between a model that makes money now compared to one that makes money over the longer haul. 
&lt;br/&gt;
&lt;br/&gt;My business plan for my illustration work is a lot more complicated, risky, expensive and just harder to do than my doing caricatures. But driving home from Santa Cruz made me realize that I can't count on doing caricatures for the rest of my life. If for no other reason, at one point I will be too old for this crap. I need a business model that creates equity from my work rather than just generating a cash flow.&lt;/div&gt;

      <title>Why Spec Work is EVIL!</title>

      <description>&lt;div&gt;I posted this up as a reply in "Breaking The Straving Artist Paradigm" Tribe but thought it would be a good topic here as well.
&lt;br/&gt;
&lt;br/&gt;I've been reading this thread on Spec Work, and to be honest, it basically it show why so many artists are "starving" in the first place. I wanted to reply in a way that covers some of the ideas I've seen posted and why I think they are WRONG!
&lt;br/&gt;
&lt;br/&gt;"whenever you are trying to break into a new market, one of the strategies available is to donate work, or to give something away for free. for example, some companies give away free samples in an effort to gain new customers."
&lt;br/&gt;	
&lt;br/&gt;	Yeah I see a lot of this at Costco too. This isn't "Spec Work" but advertising. What they are giving away in inventory already made and the cost of doing so is so small as to make it worth while. For a Multi-Million dollar food company, the costs of opening a box of cereal and giving away small cups of it for people to taste is dirt cheap.
&lt;br/&gt;	Spec Work for artists on the other hand, means we are expected to create a product and then give it away, in hopes that people will want to buy more, at a fair market price, later. No-one would make a whole product line of cereal, and then give it away to customers in hopes of making a market. They would set a price for the product first. Then advertise it to people. Then the value of the product will create the market for it. 
&lt;br/&gt;
&lt;br/&gt;"I have a buddy who has an idea he calls a "judo economy". If you are pushing your work, you can give it away. If someone is pulling (requesting) your art, you sell it."
&lt;br/&gt;
&lt;br/&gt;	For any business to survive it must be able to establish a fair market price for it's product. If you are giving away your work, then your established price is FREE. If you are just waiting for someone to request to buy your product, then the established price is whatever they offer (which most likely would be less than the fair market value). In any case, you are giving away any leverage you have in getting a fair price. 
&lt;br/&gt;	And by the way, I studied Judo when I was younger. It is all about leverage!
&lt;br/&gt;
&lt;br/&gt;"If a commercial location asks me to do a mural for free and is willing to pay for materials, I'm all over it. I add an advertisement for my work in plain sight in the mural and tend to get numerous new contacts as a result."
&lt;br/&gt;
&lt;br/&gt;	But if you charged them for the job, then they would be paying for all the materials anyway PLUS your time doing it. In this case, you are exchanging your time and effort for advertising space. Now I don't know what the job cost would be for a mural? It might be a good deal or it might not. It would depend on what the actual dollar value of your time as an artist is worth, compared to what the dollar value of the advertising would be? If you didn't get at least 4 FULL paying jobs, at a rate equal or above what you would have gotten for the one free one, then it wasn't worth it.
&lt;br/&gt;
&lt;br/&gt;"Just wondering - why do you say that working "on spec" is unethical? If I like a project, I'll work on spec, because even if they don't want to buy the work in the end, I'll still have a new portfolio piece."
&lt;br/&gt;
&lt;br/&gt;	Rule #1 of business: Time Is Money.
&lt;br/&gt;	If you have put any amount of time in a project and the customer doesn't pay you for it, then they have taken your money just as much as if they reached into your bank account and yanked it out! ( And last I heard, ripping people off is still considered unethical.) I can do as many "portfolio pieces" as I want for free. Why do I need to do one for some cheap S.O.B. instead? 
&lt;br/&gt;	
&lt;br/&gt;"You have to get 'noticed' first, before you can obtain the trust of the customer."
&lt;br/&gt;
&lt;br/&gt;	But that is why God created advertising. Using Spec Work to do this is sort of like saying women need to put out to a guy in order for them to be interested in you. Unfortunately for guys like me, most women I know have more self-esteem than that. (Darn it!) But I'm amazed at the number of artists who still hold on to the idea.
&lt;br/&gt;	Actually, customers will "trust" you far more if you are professional, than if you are cheap. In fact for many, price is not an issue at all but dependability is. In the illustration field, art directors will go with an artist they know can make their deadlines rather than someone cheaper and better but who may not. 
&lt;br/&gt;	If you have a fair price though, then it shouldn't be an issue. If it is then maybe this isn't a customer you can trust? In most businesses, you have what is called the 80/20 rule, 80% of your income will come from only 20% of your customers. So it is not how many customers you can get but how many you can get that are worth keeping.
&lt;br/&gt;
&lt;br/&gt;
&lt;br/&gt;	The exception that proves the rule on Spec work is writers. Most authors actually work on a novel before they have a publisher. So in a way, they are working on spec. But even among published authors, only a few are making enough to make their sole living from it. Only the most desperate would write a book on assignment for a publisher unless they had a contact for it and none would give a book away for free to someone just on the hope that they will buy the second novel. There is too much investment of time for them to be cavalier about it. Most comic book blogs I have followed are filled with tales of woe from comic book creators that have signed bad contracts with publishers just to see their work in print. 
&lt;br/&gt;
&lt;br/&gt;	When you give work away for free, the person paying for it is you.&lt;/div&gt;

&lt;br/&gt;
&lt;br/&gt;The templates are already layed out and you also have a few choices, I believe that some even set up payment methods.

&lt;br/&gt; So my question is does any body know of any template art sites that have worked well for them 
&lt;br/&gt; At the moment I have my work featured on a photography site which works great as a portfolio site ... but is geared towards photographers.

      <title>Business planning?</title>

      <description>&lt;div&gt;Color me curious. I see a lot of artist complain about how hard it is to make money with their art but I have to wonder how many of them have a real business plan to begin with? For the past couple of years I have been trying to put together a business plan that would allow me to make money doing what I love to do. Like it or not, making art is either a business or a hobby. If it is a business, then you need a solid plan to guide you through all the multitude of small details of running a business. (If it is a hobby, then you need a real job.) I wonder if anyone here has had any luck coming up with a plan to making money from their art?&lt;/div&gt;

      <title>Congress considering the Orphan Works act again</title>

      <description>&lt;div&gt;It seems that Congress is once again considering the Orphan Works act again. This would change the existing copyright laws to expand what is to be considered an "orphaned work" . An orphaned work is a work of art where the copyright has lapsed because of either on purpose, because of the passage of time or lack of proper registration. It can then be used without your permission for any purpose. Up until now, this has been mostly work where because the artist has passed away and their estate has allowed the copyright to become public domain.
&lt;br/&gt;
&lt;br/&gt;Changes would be to expend this to work by living artists! Artwork that is not registered with the copyright office or with newly created private "copyright registries" will be considered "orphaned" and free for anyone to use. Copyright violators can get exception from infringement suits if they claim to have made a "reasonably diligent search" for the copyright holder.
&lt;br/&gt;
&lt;br/&gt;This is something that would adversely affect every artist currently working today. Artists would have to spend hundreds if not thousands, of dollars each year to register their own work. And this would not even guarantee the same level of legal protection we have today. It would effectively gut any copyright protection we have.

      <title>Who owns the files on my website?</title>

      <description>&lt;div&gt;Hey all,
&lt;br/&gt;
&lt;br/&gt;I have a situation... My wife paid another performing artist to create a website for her, which in their arrangements included hosting.
&lt;br/&gt;For my understanding this is a work for hire, since he would not have made this website otherwise, without her payment.
&lt;br/&gt;

&lt;br/&gt;
&lt;br/&gt;Now that the registry of her URL is coming up, he does not want to send us the files for the site so we can reload it onto the hosting plan that I have for my websites. He claims it is not their policy to release files. We like the base design, while the mystery meat navigation is slow and buggy, the base of the design is nice. We offered to keep his design credits unless a complete overhaul occurs, since we like the visual layout. For my knowledge, my wife paid for:
&lt;br/&gt;1. graphic design of the site
&lt;br/&gt;2. hosting from web release until this summer, seperately from basic design cost
&lt;br/&gt;3. registry of her URL, which was put in her name under his business.
&lt;br/&gt;
&lt;br/&gt;What to do?
&lt;br/&gt;Do we keep the base design and re-script the back-end if he chooses to not send the files of the complete site?
&lt;br/&gt;What exactly are you buying when you contract for a site to be built, if not the files that comprise the site?
&lt;br/&gt;Recommendations?
&lt;br/&gt;

      <title>Bad clients</title>

&lt;br/&gt;
&lt;br/&gt;I have just recently started my custom airbrushing business. So far, I have had two bad clients in a row. The first guy wanted me to airbrush T-shirts for a High School basketball team, the Waterloo Wildhawks. He sent me the initial $200 to start the project, then when I had completed the project and delivered the T-shirts to him, he handed me a check. Later, the check bounced. I have called his phone numbers numerous times. I have sent him e-mails as well. I have contacted his head coach at the University, who told me since it has 'nothing to do with the University' it has nothing to do with him. I have contacted the head of the Waterloo Wildhawks, who told me that both himself and the guy who bounced the check are 'very busy'. I suppose I could take the check to the bank where it was drawn to resubmit it, but that's in another city from me (I am in Hamilton, Ontario....he is in Waterloo, Ontario. This is an hour drive.) 
&lt;br/&gt;
&lt;br/&gt;This guy is obviously dodging me. It looks as though I will have to take him to court. 
&lt;br/&gt;
&lt;br/&gt;Then, I had someone who wanted me to do his motorcycle for him. He was rude and obnoxious from the start, demanding that I drop my price. When he asked me how long it took to do a motorcycle helmet, I told him it took two weeks. He told me 'You've got a week!' I spent all week on that project, spraying a coat of paint, drying with the heat gun, sanding it. After a week was over, he said if the helmet wasn't ready then he would take it to someone else to do it. I had the design he asked for done, but I couldn't get it clear-coated. I have to send the clear-coating out to someone else, and he just had a truck come in. The client told me that since I didn't have it clear-coated for him, that I wasn't a 'professional'. Therefore, he would not be paying me for the job I did....only $60 to cover the cost of paint. I was so upset, I took the money and just let him go...even though it cost me $150 in materials and 30 hours in labor to do that helmet....which was fine. I could show you photographs of it if you wanted to see them.
&lt;br/&gt;
&lt;br/&gt;In any case, I have learned to NEVER accept checks from people. Also, I have learned to prepare an invoice for the materials that I use on a project, including the materials as well as (my) labor costs. I still have a problem being assertive with people. 
&lt;br/&gt;
&lt;br/&gt;Has anyone else had a problem with clients? &lt;/div&gt;

      <description>&lt;div&gt;I've been having a lot of difficulty marketing my cafepress store... I'd be really grateful for any suggestions of ways I could improve traffic.

&lt;br/&gt;Right now the store generates roughly one sale per month and generates not quite enough commission to cover the store fee. 
&lt;br/&gt;
&lt;br/&gt;I've been through several iterations of changing the layout and text on the store itself. I've added keywords to all the images in the store, which is responsible for most of my sales but really doesn't generate traffic in my store because of the way cafe press is designed. I've copied most of not all of my images to my tribe photos, and to my Deviant Art gallery ( http://smolderingremains.deviantart.com ) and I've linked to the store in the description of every image. I've purchased advertising on Deviant Art which unfortunately can't link to the store directly, it has to link to the Deviant Art profile, so it hasn't really generated any traffic to the store. I've posted a number of images to the photo galleries in a number of tribes here like the Puns tribe, again with links to the store in the description.

      <description>&lt;div&gt;What group shows have you participated in and what came from it?  What did you do to be accepted into these shows?

&lt;br/&gt;I've been in 2 cannable flower shows and met some really nice people.  To be in it you just need to show up with your art something like a day in advance if I remember correctly.
&lt;br/&gt;
&lt;br/&gt;I was in the Tom of Finland erotic art show in West Hollywood and sold a very nice 800.00$ wood penis.  I contacted TOF and was invited to be there.
&lt;br/&gt;
&lt;br/&gt;My stuff is currently at Dr. Susan Block's Speakeasy Gallery and she tells me a group show is coming up soon.  I contacted Dr Suzy, interviewed with her and promoted myself at one of her parties/filmings.  No sales yet.&lt;/div&gt;

      <title>First Art Show</title>

      <description>&lt;div&gt;OK, I've been an artist for many years now. But only in these last couple of years have I been very serious about it. I'm back in school, and intent on a show this summer. So now what? How should I best present my work? How do I price it? Is there room for haggling? 
&lt;br/&gt;
&lt;br/&gt;The next question on your minds is "What kind of art do you do?"  Well, I do botanical illustration. Pretty pictures of plants. My tribe profile has some. But I'm also wanting to work on things based on that fine detail of plants mixed with backgrounds, and who knows what. (That's why I'm in school.) I'm working in graphite, colored pencil, watercolor, and photography. Most of the work isn't big. From the graphite leaf that's about 4" x 4" to say, 20" paper. however I have a photography montage that's about 22" x 36". 
&lt;br/&gt;
&lt;br/&gt;So, back to my questions. Help?&lt;/div&gt;

Nothing too complicated, in fact basic black and square would do just fine most of the time.  Aaron bros isnot cutting it any more and I'm looking for 2x3 aspect ration frames usually and they are hard to find unless you go custom. I have tried a few online companies and haven't been too impressed, they require you to use plexi etc... Any recommendations would be greatly appreciated...

&lt;br/&gt;She wanted to do it for free, but I was thinking about giving her a commission. Just the fact that payed people work harder and to seperate work from friendship.

&lt;br/&gt;What kind of contract can I do?
&lt;br/&gt;She wants to take my pictures to a local printer and print postcards/posters
&lt;br/&gt;
&lt;br/&gt;- do I pay for the printing and when she sells it, I get 80? %?
&lt;br/&gt;-does she pay for the printing and when she sells it I get 20%?
&lt;br/&gt;
&lt;br/&gt;Is that the procentage that is normal?

      <title>A rose is a rose...???</title>

      <description>&lt;div&gt;Well then..Guess what happened to me...
&lt;br/&gt;A local art gallary contacted me last summer to have my art on display and for sale. Neat. All fine.Got some things in. Got a contract. no worries.
&lt;br/&gt;Not a lot off people came, but they just started so give it some time.
&lt;br/&gt;Last week, when it slowed down with my summer markets, I decided to pay them a visit and see if anything sold.
&lt;br/&gt;
&lt;br/&gt;..... the gallery was GONE.
&lt;br/&gt;It was now called Shrooms and outside it looked like a "hippy" store. Although there were some of the same things in the window displayed. What is going on????
&lt;br/&gt;
&lt;br/&gt;When I came in there was the same lady who had the art gallery. She decided to change the name and make it a store instead of an art gallery. She gave back the big paintings to the artists, but the rest was exactly the same. My pieces were still there. On their happy spot.
&lt;br/&gt;She apologized that I didnt recieve a phonecall, cause she tried to contact all the artists to tell them about the name change. She said that since she changed the name, there are a lot more people coming in and buying things. Now she attracts lots off young people who also buy art. Instead of a few people who came in and expected a fancy gallery and were disapointed by all the hand made jewerlry.
&lt;br/&gt;As long as it sells its fine by me. Sad thing is, now i can't say anymore my stuff is in an art gallery. It had such a nice sound to it :-)&lt;/div&gt;

      <description>&lt;div&gt;This fall I will be showing at the exotic erotic ball and some shows and expos and would like to accept credit cards.  My work may cost much more then the average buyer will have on them (1000+).  I thought that I would use paypal virtual terminal but was rejected because my work was deemed paraphernalia and against company policy.  Does anyone have any suggestions?  &lt;/div&gt;

Aspiring meaning Ive only finished my first college-level cartooning class about a week ago, Im still in high school and Ive been drawing since 6th grade, but yea.... I hope, when I get the funds for all the bristol and copies I'll need, that I can start making markitable mini comics and the like to get me known for when I start my own sagas... Ive got two in mind, one longer than the other.

&lt;br/&gt;
&lt;br/&gt;However, I really believe people buy art because it is expensive...I don't know if you can sell your pieces for 300 and make a living at it. Don't sell yourself short. People don't buy Art because its cheap. They buy it because it's expensive. Raise your prices...and make the work so good it will be worth what your ask. You can do it...

Anyone successful at this, make a profit, loose money? Is it worthwhile? How much is the average festival,, numbers, etc. ?

      <description>&lt;div&gt;Beginning in March next year, we are inviting 9 people to cruise from Bodrum, Turkey along the Turkish coast, Cyprus, Athens, Alexandria on a share expenses basis (very, very inexpensive). We began a documentary in Paris and Turkey last year, and now as it gets warmer in Turkey we are going to complete it. We have a US distributor, and everyone involved will share in profits. It could be quite profitable for you and a real life changer. We are in pre-production of three others...one on black jazz in Paris after WWII until now. We have a Turkish captain/crew/cook on our 70' Gulet, 6 double staterooms still available, all with their own head (toilet and shower). Qualifications? Simply to be able to get along with people. Age? Our producer is 60, our editor is 25. Age inmaterial if you are young in spirit. If you have video experience (HD MiniDV PAL and Final Cut Pro, writing) all the better, but we are doing this to perhaps expand the focus of our documentary which is based on the mystical aspects of Alexander the Great - Title: Force of Evidence. Creative people get free reign as long as they don't sink the ship or the project. We are interested to add some human interest...profound, provocative, funny...to the program, so film making experience in not a requirement. Come for a week or two months.       <title>Retainer for Art Commissions</title>

      <description>&lt;div&gt;Is it standard and/or acceptable to require a retainer for a commissioned work of art?  A percentage?  By retainer, I don't mean a deposit because deposits are refundable.  It's more of a "if you want me to start doing the work, you need to pay me some money and if you decide later you don't want it, I've already done the work so you're not getting your money back".  
&lt;br/&gt;
&lt;br/&gt;And what about contracts?  Or do they scare people?
&lt;br/&gt;
&lt;br/&gt;As a photographer, I require these things.  My boyfriend is a painter (and draws) and has recently been screwed by people who paid nothing up front and now seem to have had a change of heart/mind/pocketbook.&lt;/div&gt;

&lt;br/&gt;I have an Epson 9800 pro digital inkjet printer available at very low rates, often 1/2 to 1/4 as much as service bureaus charge, and am interested in working with photographers and artists to print images of their work. 
&lt;br/&gt;
&lt;br/&gt;Many are familiar with the fine photo and fine art papers available, but many are not yet very familiar with printing on canvas. Your artwork can look superb on canvas as well, and the results are archival.  
&lt;br/&gt;
&lt;br/&gt;You can increase and extend the exposure of your work with accurate and long-lasting prints on many media including aluminum, vinyl and silk.  It's possible to make more from selling prints than in selling originals, and you can do both.
&lt;br/&gt;
&lt;br/&gt;If you are interested in printing at a fraction of the retail costs out there, please contact me. For example if your files are ready to go there is no setup fee, and printing on papers is $6.50/square foot and $8.50 for canvas.       <description>&lt;div&gt;Is there anyone exhibiting at the art expo in NYC.  I saw that the art expo is accepting solo artists not affiliated with major galleries.  Is there anyone in this group exhibiting.  Has anyone exhibited in the past.  I am very curious about this aspect of marketing my work and the amazing exposure it would bring.  I have never been, so this year i think I will attend and see if I can drum up some interest.  I am interested in any and all feedback about this.

&lt;br/&gt;Hi, I am new here, and there's not a single day that I don't think about money and art.

&lt;br/&gt;For Instance:
&lt;br/&gt;
&lt;br/&gt;"Thomas Eakins painting "the gross clinic" was recently sold for $68 million.In 1878 the alumni of Thomas Jefferson University paid $200 so the school could buy a painting depicting a revered professor, Dr. Samuel D. Gross, performing an operation on a man’s thigh." Yuck
&lt;br/&gt;
&lt;br/&gt;
&lt;br/&gt;So the artist got $200 (equivalent to $3,500 in 2005 dollars) and the school $3.3 million (or 68 million today) It breaks my heart.
&lt;br/&gt;
&lt;br/&gt;
&lt;br/&gt;I propose that from now on,every artist writes behind their canvases the following note:
&lt;br/&gt;
&lt;br/&gt;"Please pay me a percentage (  %) of our work of art if you resell it, or in case of my tragic death please make sure it is payable to :______________"
&lt;br/&gt;
&lt;br/&gt;

      <title>Museum shows on the Horizon.  What should I do.</title>

      <description>&lt;div&gt;Hello. Biz of Art tribe members. I am about to get a huge break for my art career. I will be featured in a museum show focusing on emerging contemporary artists. I will be among fifteen artist that stretch from Canada to mexico featured in the Heard Museum in Phoenix (2007). That Show will then travel to NYC to the National Museum of the American Indian and will open in Summer 2008. 
&lt;br/&gt;
&lt;br/&gt;My question to you all is what should I do. How do I act. Has anyone else gone through this?

      <title>info cards for art at show - need help</title>

      <description>&lt;div&gt;I'm preparing for my first art show and I'm wondering how to put together my little side cards.  I'm know I should be putting:
&lt;br/&gt;- the peice's name
&lt;br/&gt;-my name as artist
&lt;br/&gt;-year
&lt;br/&gt;-medium
&lt;br/&gt;-dimensions 
&lt;br/&gt;-price
&lt;br/&gt;
&lt;br/&gt;does that sound right?  Am I forgetting something? Now my questions are:
&lt;br/&gt;- in what order do I put them?
&lt;br/&gt;-where should I put gaps between the text? 
&lt;br/&gt;-what do I bold and what do I put in itallics?
&lt;br/&gt;-when I put the dimensions, is that of the work itself or of the work including the framing?
&lt;br/&gt;
